By accessing or using the RisingBell Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Platform.

5. User Responsibilities

You will treat tutors and other users with respect and refrain from engaging in any harmful, abusive, or disruptive behavior. You will not misuse or exploit the Platform for any unauthorized purposes.

6. Tutoring Sessions

Tutoring sessions can be scheduled, rescheduled, or canceled through the Platform. Certain fees or penalties may apply for changes or cancellations, as outlined in the pricing and refund policy provided on the Platform.

7. Payment and Fees

By using the RisingBell Platform, you agree to pay the fees associated with the tutoring services as specified on the Platform. Payment must be made in accordance with the provided payment instructions. All fees are non-refundable unless otherwise specified in the refund policy.

8. Intellectual Property

All content and materials provided on the RisingBell Platform, including but not limited to text, graphics, logos, and software, are owned by RisingBell or its licensors and are protected by intellectual property laws. You agree not to use, copy, modify, distribute, or reproduce any content from the Platform without prior written consent from RisingBell.

9. Privacy and Data Protection

RisingBell collects and uses personal information in accordance with its Privacy Policy. By using the Platform, you consent to the collection, storage, and processing of your personal information as described in the Privacy Policy.

10. Limitations of Liability

In no event shall RisingBell or its tutors be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with the use or inability to use the Platform.

11. Termination

RisingBell may, at its sole discretion, suspend or terminate your access to the Platform without prior notice, for any reason or no reason, including but not limited to a violation of these Terms of Service. Upon termination, your right to use the Platform will immediately cease.

12. Modifications

RisingBell reserves the right to modify or update these Terms of Service at any time without prior notice. Your continued use of the Platform after any modifications constitutes your acceptance of the updated terms.

13. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which RisingBell operates. Any disputes arising out of or relating to this Agreement or the use of the Platform shall be resolved exclusively through arbitration, in accordance with the rules of the chosen arbitration provider. The arbitration shall take place in the jurisdiction where RisingBell operates, and the decision of the arbitrator shall be binding and final.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

This Agreement constitutes the entire agreement between you and RisingBell regarding the use of the Platform and supersedes any prior or contemporaneous understandings or agreements. Any failure by RisingBell to enforce any provision of this Agreement shall not be deemed a waiver of such provision.
